Validity and Renewal

A registered trademark in Lebanon is valid for 15 years from the filing date, which is notably longer than many other jurisdictions where the standard is 10 years. The registration can be renewed indefinitely for successive 15-year periods by filing a renewal application and paying the required fees before the expiration date.

Enforcement of Trademark Rights

Lebanon provides both civil and criminal remedies for trademark infringement. Trademark owners can take action against unauthorized use, counterfeiting, and imitation of their marks. Enforcement measures include:

Priority Rights Under the Paris Convention

Under the Paris Convention, applicants who have filed a patent application in a member country may claim priority in Lebanon within 12 months from the initial filing date. When claiming priority, the Power of Attorney and priority document may be submitted within three months from the acceptance date.

Opposition Proceedings

Lebanese law does not provide for opposition proceedings against patent registrations.

Patent Term and Maintenance

Once granted, a patent is protected for 20 years from the grant date, subject to the payment of annual maintenance fees. A six-month grace period is allowed for late payment of these fees.

Registration Timeline

In general, the patent registration process in Lebanon is completed within approximately two weeks. The official patent certificate is usually issued within two weeks following registration.

Compulsory Licensing

After three years from the patent grant, any interested party may request a compulsory license if the patent owner has not exploited the invention in Lebanon, or has ceased exploitation for a period of three consecutive years without a valid reason. This provision is designed to ensure that patents serve a productive role in the Lebanese economy.
